QubeCare processes Protected Health Information on behalf of healthcare providers in accordance with HIPAA regulations. PHI is governed by our Business Associate Agreement (BAA) and is handled with the highest level of security and compliance. We do not use PHI for marketing or advertising purposes.

Information Sharing

We do not sell your personal information to third parties. We may share your information only in the following circumstances:

  • With service providers who perform services on our behalf (hosting, analytics, payment processing)
  • When required by law, regulation, legal process, or governmental request
  • To protect the rights, property, or safety of Alpha Labs LLC, our users, or the public
  • In connection with a merger, acquisition, or sale of assets, with appropriate notice

Data Security

Terms of Service

These Terms of Service ("Terms") govern your access to and use of the QubeCare platform and services provided by Alpha Labs LLC ("Company," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using QubeCare, you represent that you are at least 18 years old and have the legal authority to enter into these Terms. If you are using QubeCare on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Services

QubeCare provides a healthcare infrastructure platform including electronic health records (EHR), scheduling, telehealth, patient portal, and related tools. We also offer custom development services, white-label deployments, and ongoing platform engineering as described in individual service agreements.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use QubeCare to:

  • Violate any applicable law, regulation, or third-party rights
  • Transmit malicious code, viruses, or any destructive content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the platform for any purpose other than legitimate healthcare operations
  • Interfere with or disrupt the integrity or performance of the platform
  • Reverse engineer, decompile, or disassemble any aspect of the platform

5. Intellectual Property

The QubeCare platform, including its design, code, features, documentation, and branding, is owned by Alpha Labs LLC and is protected by intellectual property laws. Your use of QubeCare does not grant you ownership of any intellectual property rights in the platform. Content you create or upload to the platform remains yours.

6. Custom Development

Custom features developed by our team for your account are subject to the terms outlined in your individual service agreement. Unless otherwise agreed in writing, custom development work performed for your account is licensed for your use on the QubeCare platform.

7. Fees and Payment

The QubeCare free tier is provided at no cost. Custom development, white-label deployments, and premium services are billed according to the rates and terms specified in your service agreement. All fees are non-refundable unless otherwise stated. We reserve the right to change our pricing with 30 days' written notice.

8. Data and Privacy

Your use of QubeCare is also governed by our Privacy Policy. If you process Protected Health Information (PHI) through the platform, you agree to execute a Business Associate Agreement (BAA) with us as required by HIPAA.

9. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to our services. We may perform scheduled maintenance with reasonable advance notice. We are not liable for any downtime, data loss, or service interruption beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by law, Alpha Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the platform. Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Alpha Labs LLC, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

12. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the platform will cease. We will provide a reasonable period to export your data. We may suspend or terminate your account immediately if you violate these Terms.

13. Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Charleston County, South Carolina.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Your continued use of QubeCare after such changes constitutes acceptance of the updated Terms.

HIPAA Compliance

Alpha Labs LLC is committed to protecting the privacy and security of Protected Health Information (PHI) in compliance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the HITECH Act. This page describes how QubeCare meets and maintains HIPAA compliance.

Our Commitment

QubeCare is designed from the ground up to be HIPAA-compliant. Compliance is not an afterthought or an add-on — it is embedded in every layer of our architecture, every engineering decision, and every operational process.

Business Associate Agreements

Alpha Labs LLC enters into Business Associate Agreements (BAAs) with all healthcare providers who use QubeCare to process PHI. Our BAA outlines the permitted uses and disclosures of PHI, our obligations to safeguard it, and our responsibilities in the event of a breach. BAAs are available for execution upon account creation.

Administrative Safeguards

  • Designated privacy and security officers responsible for HIPAA compliance
  • Comprehensive workforce training on privacy and security requirements
  • Documented policies and procedures for PHI handling, access, and incident response
  • Regular risk assessments to identify and address vulnerabilities
  • Sanctions policy for workforce members who violate HIPAA requirements

Physical Safeguards

  • Data hosted on HIPAA-eligible cloud infrastructure with SOC 2 compliance
  • Physical access controls at all data center locations
  • Secure workstation policies for all team members with access to PHI
  • Device and media controls for the disposal and reuse of electronic media

Technical Safeguards

  • AES-256 encryption for data at rest
  • TLS 1.2+ encryption for all data in transit
  • Role-based access controls (RBAC) limiting PHI access to authorized personnel
  • Unique user identification and automatic session management
  • Comprehensive audit logging of all PHI access and modifications
  • Multi-factor authentication for administrative access
  • Automated backups with encrypted, geographically redundant storage

Breach Notification

In the event of a breach of unsecured PHI, Alpha Labs LLC will notify affected covered entities without unreasonable delay and no later than 60 days following discovery of the breach, in compliance with the HIPAA Breach Notification Rule (45 CFR §§ 164.400–414).

Subcontractors

All subcontractors and third-party service providers who may have access to PHI are required to enter into BAAs with Alpha Labs LLC and maintain equivalent security standards.

Continuous Improvement

We conduct regular internal audits, vulnerability assessments, and penetration testing to ensure our security posture evolves with the threat landscape. Our compliance program is reviewed and updated at least annually.
